Moscow City Court upholds half-million-rouble fine against HRC “Memorial”*

The court of appeal did not grant the complaint filed against the decision to fine the Human Rights Centre (HRC) “Memorial”* 500,000 roubles for the lack of marking of a foreign agent. The court considered the case contrary to the law providing that the exclusion of an organization from the register of legal entities should be a reason for terminating the case on administrative punishment.

The “Caucasian Knot” has reported that on December 15, 2021, the Tverskoi Court of Moscow fined the HRC “Memorial”* 500,000 roubles for the lack of marking of a foreign agent in a post. On May 18, after the liquidation of the HRC “Memorial”*, it was excluded from the Unified State Register of Legal Entities. The exclusion took place before the completion of the liquidation of the organization and created difficulties for the “Memorial”* in paying off its debts.

On December 29, 2021, the Moscow City Court pronounced a decision on liquidation of the HRC “Memorial”* at a lawsuit of the Prosecutor’s Office, and on April 5, the court of appeal upheld the decision on liquidation. In June, the team of the former Human Rights Centre created the organization Human Rights Protection Centre “Memorial”.

The Moscow City Court considered the appeal against the decision on a fine of 500,000 roubles, pronounced on December 15, 2021, and upheld it, the Human Rights Protection Centre “Memorial” reported.

*The organization was included by the Russian Ministry of Justice (MoJ) in the register of NCOs, performing the functions of a foreign agent, and was liquidated by a court’s decision.
