Makhachkala resident to get compensation for unlawful criminal prosecution

The Russian Ministry of Finance requested court to reduce the amount of compensation for Patimat Akhmedova, referring to the possibility of “unjust enrichment” of the victim.

The woman requested compensation for moral damage caused by unlawful criminal prosecution.

Patimat Akhmedova was accused under the criminal article on illegal possession of drugs, which stipulated a sentence of up to three years of imprisonment. As a result, the law enforcement bodies closed the criminal case against Patimat Akhmedova, admitting that there was no crime in the woman’s actions.

In her lawsuit against the Russian Ministry of Finance, the Makhachkala resident requested 5 million roubles in compensation. An official from the Ministry of Finance called on the court “to prevent the unjust enrichment of the victim.” In July, the court obliged the Russian Ministry of Finance to pay Patimat Akhmedova the compensation, but its amount was reduced to 300,000 roubles.

The “Caucasian Knot” has reported that about the case instituted against Makhachkala resident Zainulabidin Mirzabekov, who also seeks compensation for unlawful criminal prosecution in a drug case. The man, who spent eight years in prison on the falsified charge, requests court to oblige the state to pay a compensation of 414 million roubles.
