Resident of Khasavyurt kept in custody unlawfully, his defender claims

Batrutdin Abdurakhmanov, a resident of Khasavyurt, is being kept in custody, although under the law, he must be released because of procedural violations. A defender of Batrutdin Abdurakhmanov has filed a complaint to the prosecutor’s office.

Advocate Aydemir Ismailov explains that a case on possession of large quantities of narcotic substances has been instituted against Batrutdin Abdurakhmanov.

“He was detained on February 12 ... He was not immediately charged. The court chose a pre-trial restriction measure for two months, that is, until April 12,” Aydemir Ismailov explained.

The advocate believes that investigators committed procedural violations by being late in filing charges, which took place on February 22.

“If the deadline for filing a charge (and a charge should be brought against a person within ten days after his or her detention) is missed, then the pre-trial restriction measure is to be immediately cancelled and the person should, in fact, be released. In the Batrutdin Abdurakhmanov’s case, the pre-trial restriction measure has not been cancelled,” the advocate reported.
