Appeal against Zhalaudi Geriev's verdict addressed to Chairman of Russian SC
The defence of Zhalaudi Geriev, a "Caucasian Knot" correspondent, has challenged the refusal to transfer the journalist's case for consideration to the cassation instance of the Supreme Court (SC) of Russia.
On April 5, 2017, the Presidium of the Chechen Supreme Court (SC) upheld the verdict to Zhalaudi Geriev, who on September 5, 2016, was sentenced by the Shali District Court to three years of imprisonment on the charge of possession of marijuana.
The "Caucasian Knot" has reported that the Zhalaudi Geriev's defence sent two cassation appeals to the Russian SC with a request to eliminate the violations committed by the Chechen courts and return the case to the first instance court for consideration. However, on July 31, a judge of the Russian SC refused to consider those complaints at the cassation instance.
On October 10, advocates Alaudi Musaev and Nadezhda Yermolaeva addressed a complaint to Vyacheslav Lebedev, the chairman of the Supreme Court of Russia, with a request to cancel the decision of the SC's judge of July 31, 2017.
"We have addressed the complaint to Vyacheslav Lebedev, the chairman of the Supreme Court, with a request to cancel the resolution pronounced by the judge of the Russian SC ... because it is absurd," advocate Alaudi Musaev told the "Caucasian Knot" correspondent.
In the complaint addressed to Vyacheslav Lebedev, advocates Alaudi Musaev and Nadezhda Yermolaeva note that while considering the cassation in the criminal case against Zhalaudi Geriev, the Presidium of the Chechen Supreme Court left without consideration and assessment the whole evidence base and the arguments presented by the defence.
The judge of the Russian SC also ignored them, the Zhalaudi Geriev's defenders believe.
