Mardiros Demerchyan's advocate claims violations in case against his client
At the trial in the case against Mardiros Demerchyan, a builder of Olympic facilities, his advocate has filed a motion to return the case to the prosecutor "to eliminate the violations, preventing its consideration at court."
The "Caucasian Knot" has reported that Mardiros Demerchyan worked in Sochi at construction of Olympic facilities and was detained on June 12, 2013, on charge of stealing building materials. Mardiros Demerchyan complained about being severely tortured at a police station. He was accused of false defamation of policemen and was once sentenced; however, the court cancelled the verdict. Then, a retrial has been launched, and the defence insists on the return of the case materials to the Prosecutor's Office because of the absence of the victim in the episode of the theft Nikolai Krasko, the director of Limited Liability Company (LLC) "Dauriya-Stroi".
At a court hearing held on December 22, the judge listened to the motion filed by advocate Alexander Boichenko.
"The materials of the criminal case contain no complaint of theft, no inventory act confirming shortage cable, and no documents for the stolen property," noted Alexander Boichenko while explaining his motion for the return of the case to the prosecutor.
"The court has found out that Nikolai Krasko does not treat himself as a victim, and he never led the 'Dauriya-Stroi'. The company does not exist at all, since it is not registered in any papers. The law does not permit the trial against the defendant in the absence of the victim," stated the Mardiros Demerchyan's advocate.
The judge decided to announce its decision in the case at the next session scheduled for January 11, 2017.
