Advocate explains cancellation of Geriev's CER

The Naur District Court of Chechnya made a procedural error in its ruling on the conditional early relief (CER) of Zhalaudi Geriev; and this mistake allowed the Supreme Court (SC) of Chechnya to cancel the ruling, Alaudi Musaev, one of Geriev's advocates, has explained.

The "Caucasian Knot" has reported that on November 8, the Chechen SC cancelled the CER for Zhalaudi Geriev, a "Caucasian Knot" correspondent.

In September 2016, Zhalaudi Geriev was sentenced to three years of imprisonment on the charge of marijuana possession. The defence insists on the illegality of the verdict. On September 18, the Naur District Court pronounced a decision on the CER for Zhalaudi Geriev. On September 28, Chechen Deputy Prosecutor Dushin appealed against the decision pronounced by the Naur District Court.

"The fact is that the Naur District Court made a mistake in formulating its ruling on Geriev's CER. Instead of 'general custody regime' the court's ruling read 'strict regime'. Because of this formal reason, the SC has cancelled the ruling of the Naur Court. Now, the latter should reconsider the CER issue," Mr Musaev explained to the "Caucasian Knot" correspondent.

According to the advocate, if not for the mistake, the SC of Chechnya had no compelling reasons to cancel the CER ruling.

“The arguments [in favour of] cancelling Geriev's CER, presented by the prosecutor, are unequivocally unjustified; there is nothing in them that could cancel Geriev's CER," Alaudi Musaev has concluded.
