Myakiev treats verdict cancellation as obstacle for considering the case at ECtHR

The decision of the Fifth Cassation Court in Pyatigorsk to overturn the sentence of Bagaudin Myakiev, a protester in Magas, may prevent the European Court of Human Rights (ECtHR) from considering his complaint, the activist himself has suggested.

The "Caucasian Knot" has reported that on August 27, 2020, Bagaudin Myakiev, an activist convicted of attacking law enforcers at a rally in Magas, was released from penal colony No. 6 in the Stavropol Territory due to the end of his prison term. On January 18, 2022, the Fifth Cassation Court in Pyatigorsk cancelled his sentence under the article on the use of violence against a state servant. The cancellation means sending the case for a new trial, Magomed Aushev, an advocate, has explained.

Bagautdin Myakiev was detained in April 2019, shortly after a rally in Magas. On February 20, 2020, the Ingush activist was sentenced to one year and nine months of imprisonment in a penal colony. The defendant admitted that at the rally he threw chairs in the direction of law enforcers, but said that he did not aim at fighters of the National Guard of Russia.

Bagautdin Myakiev himself has stated that he expects no acquittal. "They won't rule an acquittal. Most likely, this (the sentence cancellation) was done to interfere with my complaint submitted to the ECtHR. In August 2020, my complaint was registered there. In order for my complaint to be accepted for consideration, there must be a response from the cassation instance. And here it turns out that the cassation court hasn't refused, but sent the case for a new trial to the first-instance court," Mr Myakiev has suggested.
