Ingush activist Myakiev treats ECtHR's decision on his complaint as fair
The European Court of Human Rights (ECtHR) has obliged Russia to pay 1000 euros to Ingush activist, Bagaudin Myakiev, for his illegal custody. This gives hope for similar ECtHR's decisions in favour of other people arrested within the case of the rally in Magas in March 2019, Myakiev himself has informed.
The "Caucasian Knot" has reported that on August 27, 2020, Myakiev, convicted of attacking law enforcers at the above rally in Magas, was released from colony after serving his term. On January 18, 2022, the Fifth Court of Cassation in Pyatigorsk overturned the verdict and the case was sent for a retrial.
The ECtHR has found that Myakiev's detention was illegal, he himself told the "Caucasian Knot" correspondent on July 22. "The ECtHR has found that I had been kept at the SIZO (pre-trial prison) for a long time in violation of Article 5 of the European Convention on Human Rights (ECHR). I had two points in my complaint – under Article 5 that I was illegally detained, and under Article 2 that I was illegally convicted," he has explained, adding that under Article 2 the ECtHR didn't make a decision because the cassation court had overturned the verdict and a retrial began.
According to the decision on the case "Kuvshinov et al vs. Russia", published on July 21 on the ECtHR's website, the ECtHR has obliged Russian authorities to pay Myakiev 1000 euros in compensation.
"Of course, this money solves nothing, but it's not about money. The fact is that the ECtHR has found the actions of Russian authorities, who had detained and kept me, and subsequently convicted me, to be illegal ... And I hope that the decision on my complaint will support those who have already been convicted under the 'rally case'," Bagaudin Myakiev has summed up.
