Participant of march in Nalchik sees no sense in filing appeal against his arrest

Kazbek Mamikov, a participant in the march in Nalchik held to mark the end of the Caucasian War, who served his administrative arrest, has decided not to appeal against the court’s decision, while two other participants in the march have succeeded in their appeals to reduce their arrest terms. There were no arrests in Maikop, but two activists had to write explanatory notes.

Kazbek Mamikov, one of those detained at the march in Nalchik, said that he came to the march to “pay tribute to the memory of his ancestors who gave their lives for freedom.” Kazbek Mamikov believes that those gathered did not violate the law. “We just didn’t know that we couldn’t walk along the avenue,” he told a “Caucasian Knot” correspondent.

The activist ha also noted that he will not appeal his arrest. “There is no sense doing that. As they say: ‘The strong always find the weak guilty’,” Kazbek Mamikov concluded.

Two marchers who filed the appeals against their arrests did not succeed in having their sentences cancelled.

As indicated in the case file on the official website of the Supreme Court (SC) of Kabardino-Balkaria, in particular, Zuber Euaz and his advocate asked to cancel the judge’s ruling as unlawful and unfounded and to terminate the proceedings on the administrative offence. However, in court, Zuber Euaz and his advocate partially supported the appeal, asking to reduce the sentence. “At the court hearing, Z.Z. Euaz fully admitted his guilt in committing the administrative offense charged to him, repented of his actions, and asked to reduce the term of administrative arrest to 05 days,” the appellate ruling of the court states.

In connection with the continuing level of terrorist threats (including the use of unmanned aerial vehicles (UAVs)) in the Kabardino-Balkarian Republic (KBR), there is a decision not to hold mass public events with the participation of a large number of citizens.

The document states that the organizers of the march in Nalchik submitted a notice of its holding on May 7, but were refused on May 12. The response from the Ministry of Nationalities and Public Projects of Kabardino-Balkaria states that the reason for the refusal was non-compliance with the requirement, “according to which the notice shall be submitted by the organizer (representative of the organizer) in person upon presentation of a passport or other document certifying the identity of a citizen of the Russian Federation and his or her age.” “In addition, the letter drew attention to the fact that, according to the information from the law enforcement bodies, in connection with the continuing level of terrorist threats (including the use of unmanned aerial vehicles (UAVs)) in the Kabardino-Balkarian Republic (KBR), there is a decision not to hold mass public events with the participation of a large number of citizens,” the Supreme Court (SC) of the KBR emphasized, noting that the first instance court correctly assessed the circumstances of the case. At the same time, the Kabardino-Balkarian Supreme Court decided to reduce the term of the plaintiff’s administrative arrest from six to five days.

A similar decision has been pronounced on the claim lodged by Timur Nakhushev. The official website of the Supreme Court (SC) of Kabardino-Balkaria does not contain any information concerning the appeal of the court’s decision by other participants in the procession who served their administrative arrests.
