Ingush SC finds refusal to re-qualify Evloev's death case illegal

The Supreme Court (SC) of Ingushetia has recognized as illegal the refusal of the district court of the republic to re-qualify the criminal case on the fact of the death of Magomed Evloev, owner of the website "Ingushetia.Ru" from the Article "Causing of death by imprudence" into Article "Murder". Despite this decision, the case will not be re-qualified.

"The Republic's Supreme Court has ruled that the first instance court made an illegal decision and cancelled the latter's decision, by which we had been refused to re-qualify the criminal case on Evloev's death," Musa Pliev, advocate of Evloev family, has reported today, having added that the Supreme Court, thus, has upheld the cassation complaint lodged by representatives of the oppositionist's family against the ruling of the first instance court.

"Our application was sent for revision to the Sunzha District Court. The SC has instructed the District Court to consider the case on the merits and made decision according to the law," the "Interfax" quotes Mr Pliev as saying.

The RIA "Novosti" is quoting Mikhail Zadvornov, Chairman of the Supreme Court of Ingushetia, according to whom, although the case has been returned to the first instance court because of procedural violations, the issue of re-qualification is out of question.

According to Mr Zadvornov, the materials of the case will arrive to the Nazran Court for consideration and elimination of violations made.
