Lawyers point to possible revision of decision of Ingush CC
The Constitutional Court (CC) of Russia may issue a different verdict on the Chechen-Ingush border than the Ingush CC; and it couldn't be reconsidered, lawyers say. They have noted that the decision taken by the Ingush CC is mandatory for execution by the regional authorities.
The "Caucasian Knot" has reported that on October 30, the Ingush CC declared the law on the new border with Chechnya unconstitutional. The head of Ingushetia, Yunus-Bek Evkurov, said that the CC's decision did not cancel the border agreement, as it had entered into force.
The decision of the Ingush CC cannot be challenged by anyone, including the CC of the Russian Federation, said Elena Lukyanova, Doctor of Law.
Evgeny Chernousov, a lawyer and retired Colonel of the Ministry of Internal Affairs (MIA), is sure that while the Ingush party is challenging the border agreement, Chechnya can carry out works in the acquired territories.
The responsibility of regional constitutional courts is not completely clear, said Igor Trunov, a lawyer. According to his version, so far, their productivity in the republics has been zero.
The head of Ingushetia cannot challenge the decision of the Ingush CC, Dmitry Timchenko, a lawyer at the "Trunov, Aivar and Partners" international law firm, believes.
The agreement was unconstitutional, since such decisions require a referendum, said Alexander Balobanov, Associate Professor at the Division of State Management of the Institute of Social Sciences of the RANEPA (Russian Presidential Academy of National Economy and Public Administration). However, the issue of fixing the Chechen-Ingush border has already gone beyond the legal framework and become political, he has noted.
