ECtHR grants complaints of two Chechens against decision to deport them from France
The European Court of Human Rights (ECtHR) has ruled on the complaints of two refugees from Chechnya against the decisions of French authorities to deport them to Russia. The ECtHR has found that in both cases the deportees were at risk of torture and cruel and degrading treatment, thus violating Article 3 of the European Convention on Human Rights (ECHR).
The decision was made on August 30; and the respective information was posted on the ECtHR's website August 31.
In the decision on the case R. vs. France (Application No. 49857/20), the ECtHR has unanimously held that Article 3 of the ECHR, the prohibition of torture and inhuman or degrading treatment, had been violated (the names of the applicants were not published, the press release used initials). In the decision on the case W. vs. France (Application No. 1348/21), the ECtHR has ruled by majority that there had been a violation of Article 3 of the ECHR, if the decision to deport the applicant to the Russian Federation was carried out, says the press service's release posted on the ECtHR's website.
