ECtHR recognizes beating and arrest of advocate Mikhail Benyash* as violation

The European Court of Human Rights (ECtHR) obliged the authorities of Russia to pay Krasnodar advocate Mikhail Benyash* 16,000 euros for beating by law enforcers after detention and for arrest. The ECtHR made the decision against the backdrop of the Russia’s refusal to comply with the judgments of the ECtHR.

The “Caucasian Knot” has reported that on March 27, the ECtHR communicated the complaints filed by Mikhail Benyash* about being detained and beaten by law enforcers in September 2018 and being arrested in January 2021.

On September 9, 2018, Mikhail Benyash* was detained in Krasnodar together with participants of an unsanctioned rally against the pension reform. According to the investigators’ version, Mikhail Benyash* used violence against the police: he grabbed and bit one of the policemen by the hand. Mikhail Benyash* himself complained that he was beaten after his arrest. On January 22, 2021, Mikhail Benyash* was detained on suspicion of organizing an unsanctioned rally and arrested for five days.

On March 6, 2023, in Krasnodar, a court sentenced Mikhail Benyash* to a fine of 30,000 roubles, finding him guilty of attacking law enforcers.
