Advocates in the Nalchik attack case to appeal against cancellation of juries

A group of advocates who participate in the process on the attack on power structures of Kabardino-Balkaria on October 13, 2005, plan to appeal to the Constitutional Court of the Russian Federation against the law adopted by the State Duma of the Russian Federation to cancel trials by jury on cases related to terrorism and other anti-state crimes.

"If the Constitutional Court decides in strict conformity with the Constitution of the Russian Federation, and I think that this will be the case, then, there is a prospect that this law will be recognized as mismatching the main law of the country," advocate Tatiana Psomiadi said to the "Caucasian Knot" correspondent.

The advocate has reported that a complaint to the Constitutional Court will be lodged in the near future. Also Tatiana Psomiadi said that initially he had moved a petition about consideration of the case by the court of three federal judges. In her opinion, instead of restricting the work of juries, it is necessary to raise the issue of better work of the inquiry.

Advocate Nelya Murachaeva has noted that although the defendants are charged with terrorism, it does not mean yet that the court will find them as such, but, nevertheless, they have already been deprived of the rights to be tried by a jury.
