Convict loses claim against prison administration

The Garadagsky District Court denied a convict's claim against a prison warden on June 4. On April 27, Namig Veliyev, who is a life termer, brought a suit against the administration of his prison, which had denied him the right to get correspondence education at the private university Khazar. Namig Veliyev's envoy is Eldar Zeynalov, director of the Human Rights Center of Azerbaijan. To substantiate his claim, the convict cited 8 international documents of the United Nations and the Council of Europe, which recommend developing the convicts' education. He also mentioned the violation of Article 42 of the Constitution, which declares that every citizen has the right to education, and Article 151 of the Constitution, which stipulates the priority of international treaties in Azerbaijan's legislative system. The case also comes under Article 2 of Protocol 1 to the European Convention for the Protection of Human Rights and Fundamental Freedoms, therefore it can be appealed in Strasbourg.

The Human Rights Center of Azerbaijan is going to continue its fight for the convict's right to education.
