ECtHR obliges Russia to pay 920,000 euros to families of disappeared Chechen residents

Today, the European Court of Human Rights (ECtHR) has pronounced the decision in the case of "Baisultanova et al. vs. Russia" and obliged the Russian authorities to pay compensation to family members of the ten disappeared residents of Chechnya.

The decision of the ECtHR in the case of "Baisultanova et al. vs. Russia" has been published on the European Court's website. The case concerns ten men who were taken away from their homes by law enforcers in 2001-2003, and their relatives never saw them again.

Investigations into the cases on kidnappings of those people brought no results. In the case of "Baisultanova et al. vs. Russia", the ECtHR found violations of Article 2 (the right to life), Article 3 (the prohibition of torture and inhuman or degrading treatment or punishment), Article 5 (the right to liberty), and Article 13 (the right to an effective remedy) of the European Convention for the Protection of Human Rights.

The total compensation awarded to the complainants amounted to over 920,000 euros, including 782,000 euros of compensation for moral damage.

According to the ECtHR's decision, the interests of the disappeared men's relatives were represented by the NGOs "Legal Initiative" and "Mothers of Chechnya".

  • Compensation decrease for illegal prosecution violates rights of KBR resident

The court ruling, which awarded Madin Gubzhokov compensation of 30,000 roubles for unlawful criminal prosecution, is incomparable with the moral harm caused by the actions of Azamat Kyaov, a former law enforcer. The amount is ridiculous and should be appealed against, lawyers and human rights defenders have stated.
