ECtHR awards compensation to mother of a Kabardino-Balkarian resident killed by law enforcers

The European Court of Human Rights (ECtHR) pronounced a decision that the Russian authorities ineffectively investigated the killing of Aslan Yemkuzhev, a resident of Kabardino-Balkaria, by law enforcers and the version that he was tortured before his death. The Strasbourg Court obliged the Russian authorities to pay 70,000 euros of compensation to a mother of the killed resident of Kabardino-Balkaria.

The “Caucasian Knot” has reported that on March 16, 2011, law enforcers killed Aslan Yemkuzhev during a counterterrorist operation (CTO) in Nalchik. According to the National Antiterrorist Committee (NAC), Aslan Yemkuzhev underwent the sabotage and terrorist training in Lebanon and fought on the side of the militants. In her complaint to the ECtHR, Khaishat Yemkuzheva claimed that her son’s body was returned to the family not only with traces of bullets, but also with signs of handcuffs, burns, and injuries to the face. According to human rights defenders, Aslan Yemkuzhev was kidnapped and tortured, and his armed resistance was staged.

Today, the ECtHR has released a ruling in which it recognized a violation of the Convention on Human Rights in the case of Aslan Yemkuzhev and obliged the Russian state to pay the mother of the killed resident of Kabardino-Balkaria the compensation for material damage in the amount of 10,000 euros and the compensation for moral damage in the amount of 60,000 euros, lawyer Rustam Matsev informed the “Caucasian Knot” correspondent.

The ECtHR found the violation of Article 2 (the right to life) of the Convention on Human Rights. “The European Court recognized that Aslan Yemkuzhev was killed by agents of the state in violation of Article 2 of the Convention on Human Rights and that the killing was not effectively investigated,” Rustam Matsev explained.
