Lawyers confirm Ingush woman’s right to compensation after CTO
The authorities are required by law to compensate for damages to a woman from the village of Zyazikov-Yurt, whose house was damaged during a counterterrorist operation, but to assess the damage, the woman needs to go to court, lawyers note.
The “Caucasian Knot” has reported that on April 5, during the counterterrorist operation (CTO), law enforcers discovered a group of alleged militants in the village of Zyazikov-Yurt. During the shootout, three law enforcers were killed, and eight others were wounded. The house where the suspected militants were hiding was riddled with dozens of bullets. A neighbouring house was also severely damaged, and its owner hopes for help from the authorities in restoring her house.
After the shootout in the village of Zyazikov-Yurt, the police of Ingushetia announced a reward for helping to find four suspects. On April 7, one of them, Amir Bokov, surrendered to the police, and later another suspect, Mikail Moshkhoev, was detained.
There were precedents when the authorities compensated for the damage caused to citizens during the CTO, but that requires the political will of the authorities, believes Magomed Mutsolgov, a lawyer and head of the human rights organization “MASHR”.
Counterterrorist operations often result in not only the loss of property, but also injuries and deaths of civilians living in the CTO zone, the human rights defender notes. He emphasizes that the authorities hardly ever fully compensated for the damage.
The defendant in the case on compensation for damage from counterterrorist operations is the state represented by the Ministry of Finance, states advocate Akhmed Abakarov. According to him, material damage should be determined by an expert.
