Father of many children from Dagestan denied deferment from mobilization

Maxim Gadjiumarov, a resident of Dagestan, has not succeeded in challenging the decision of the court, which denied him a deferment from mobilization, although he takes care of his three minor children and pregnant wife.

The “Caucasian Knot” has reported that residents of Southern Russia have repeatedly complained about, in their opinion, unlawful mobilization of men who suffer from serious health problems or who have a reservation from mobilization.

The Southern District Military Court in Rostov-on-Don approved the decision of the Garrison Military Court of Makhachkala, which refused to grant a deferment from the mobilization to Maxim Gadjiumarov, a resident of Dagestan, the “Kavkaz.Realii”* reports.

The complainant stated that he had three dependent children under 16 years of age. The man also indicated that his wife was 22 weeks pregnant at the date when the complainant filed an appeal for reconsideration of the court’s decision. Meanwhile, in accordance with the Federal Law “On Mobilization”, a deferment is due to those men who have three dependent children under the age of 16 and a wife whose pregnancy is at least 22 weeks.

The court of appeal pointed out that at the time when Maxim Gadjiumarov had filed the complaint, his wife was four weeks pregnant, so his complaint could not be granted.
